The Netherlands has some very stringent data privacy laws which also include European Union legislation, especially the General Data Protection Regulation. The country has a strong sense of importance for the protection of personal data and individual privacy rights.
GDPR Compliance
As a member of the EU, the Netherlands is subject to the GDPR, which took effect in May 2018. The GDPR provides an overall framework for the protection of personal data with an objective to harmonize the data privacy laws across Europe. Key principles under the GDPR include:
Data Protection by Design and by Default: Organizations must integrate privacy measures into their business processes and technologies.
Consent: Personal data must only be processed with the explicit consent of the data subject, unless another legal basis applies (e.g., contract necessity or legal obligations).

The AP ensures compliance through complaints, audits, and fines for non-compliance. It also provides guidance to businesses and individuals on their rights in terms of data protection.
Dutch Data Protection Law (UAVG)
Besides the GDPR, the Netherlands has its own national data protection law: the Uitvoeringswet Algemene verordening gegevensbescherming (UAVG), which came into effect together with the GDPR. The UAVG adopts certain provisions of the GDPR within the context of Dutch law. For instance, specific rules can be found within the UAVG on processing personal data in the framework of law enforcement and intelligence services.
Data Protection in the Employment Context
Dutch labor law also provides for data privacy in the workplace. Employers are to respect the GDPR while processing information about employees and shall notify them of the purpose of processing their data. Data processing in the employment context should be limited and adequate.
Penalties and Enforcement
Non-compliance with data protection laws may attract very heavy fines. The AP was given the authority to fine up to 20 million euros or 4% of an organization's global annual turnover, whichever amount is higher. The Netherlands is one of those countries that have a reputation for being very strict with data privacy laws, and thus compliance is key for any business set up in the country.
In all, the Kingdom of the Netherlands implements data privacy laws according to the GDPR and further offers extensive protection for personal information via national legislation along with active enforcement by the AP.
